Actually pirating is copying a disc in order to distribute, creating a backup is not pirating, and is the only way you can protect against damaged disc's as companies would not provide another disc even if you got a valid key.
I tried to copy a bit of the 2012 ruling here, but couldnt due to the blocks the forum puts onto words and didnt want to change the wording which was used in the judgement. In short it basically said that even if a agreement had been made (forced be ToS/EULA) the company could not prevent the resale of a tangible or intangable product. It is a European Court judgement and thus can overwrite local european laws. |
