In almost every court in the "civilised" world, the ToS is actually often deemed unenforceable and in some the conditions of it are outright ill.egal. Actually is really interesting reads if you find some the case notes on this stuff because it shows that games companies are actually talking crap at time.

(ie Copying a disk as a backup is not ill.egal, although companies try to push off that it is in the ToS .. etc etc"

that is what you call pirating hahahahaha

Actually pirating is copying a disc in order to distribute, creating a backup is not pirating, and is the only way you can protect against damaged disc's as companies would not provide another disc even if you got a valid key.

I tried to copy a bit of the 2012 ruling here, but couldnt due to the blocks the forum puts onto words and didnt want to change the wording which was used in the judgement. In short it basically said that even if a agreement had been made (forced be ToS/EULA) the company could not prevent the resale of a tangible or intangable product. It is a European Court judgement and thus can overwrite local european laws.

FYI An admin doesnt need to know your real id if they have your ip.
