Yeah, I see your point. Though I'm sticking behind the "He had a Code" Theory since he was able to show Nunally his past like how C.C did by touching him.

You know the Code thing? People say it's a theory but i think it's more than that,cuz we know how Code works. If you touch a person which has a Code,you'll see their past ( Remember C.C used that to paralyze Suzaku and when Lelouch touched her the same happened ). At the ending(you know what i mean,just don't wanna spoil too much,people might actually read it accidantally),Lelouch's sister touched Lelouch and she saw what his brother did for world and herself. So there it goes,Lelouch did his contract with C.C,took her immortality and her Code. In short,i believe he's alive.
Talking about those shit made me hyped again,gonna watch the ending again and cry in a corner lol
