From my point of view, if Nakai is proven that he wanted to sell the acc, which is prohibited by terms and conditions, YES the acc should be banned.
Zed should not get the acc EVEN if he did pay for it, because he also is in direct violation of the terms and conditions.
Nakai, even if he wanted to sell the acc, can be considered a scammer ONLY if he did get the money promised from the buyer. If he did not, Zed is the actual scammer, for trying to steal what is not his.
